Deposit conditions - Sellers

A. General filing procedures

The company acts as representative of the seller.
Items are accepted for auction exclusively onlineon a monthly basis, ending each month. last Wednesday of the month.
Le sale mandate is tacit by the very act of depositing an object.
A commission of 15 % incl. VAT is deducted from the auction price for private individuals, 10 % for professionals.
From fixed fee of €5 per lot are due, whether or not it is sold.
Each batch must have a minimum biddefined according to its nature and value.
The seller may set a reserve priceprovided that it is reasonable and accepted by Le Temps Jadis Auction.

B. Transport, insurance and liability

No free transport service is proposed.
The items deposited are not insured by Le Temps Jadis Auction. The depositor is invited to take out cover himself if necessary.
In the event of damage, the hall is liable for strictly limited to the amount that may be covered by its insurerif applicable.

C. Unsold items

Unsold items must be taken back by the seller within 7 days working days following the sale.
On request, unsold items can be put back on sale at a revised price.
After the withdrawal period, custody charges may apply at the rate of 5 per day late and per lot.
No automatic disposal, donation or destruction of unsold items will be considered without the express agreement of the seller.

D. Legal and tax aspects

Le resale rightif applicable, is to be at the buyer's expense.
The origin of the objects is not mentioned in the catalogues or communications.
No transfer of image rights, force majeure clause or Mandatory written mandate is required.
In the event of a dispute, only the courts of Nivelles are competent.
La Belgian legislation is exclusively applicable.

Purchasing conditions - Buyers

A. Fees & payment

Each auction is accompanied by buyer's fee of 25 % incl. VAT.
These costs are clearly stated in each sale.
The payments must be made within 10 days calendar after the auction.
Means of payment accepted : Bancontact, Visa/Mastercard, bank transfer, QR code, cash (within legal limits).
In the event of non-payment :
- Interest on arrears will be payable at the legal rate.
- A flat-rate allowance of 15 % with a minimum of €75 will also be required.
- The seller can, after 30 daysdecide to cancel the sale.

B. Withdrawal of objects

Items purchased must be withdrawn within 10 days following payment.
No delivery service is offered by default.
In the event of failure to withdraw by the deadline storage costs may be charged or the sale cancelled at the seller's discretion.

C. Auctions & right of withdrawal

Sales are exclusively online.
The right of withdrawal is available to private consumersexcept in the following cases :
- Sales supervised by a ministerial officer.
- Public sale with the possibility of assistance.
The right of withdrawal must be exercised within 14-day period from the date of receipt of the goods, provided that :
- The buyer has paid and withdrawn object.
- He returns the item at its own expense in original condition.
- It notifies its intention via post or email accompanied by the official form.
Items are sold in the state, without guarantee and descriptions and photos are not binding.

D. Miscellaneous clauses

Le Temps Jadis Auction reserves the right the right to refuse a bid or a bidder without justification.
No commitment has been made regarding theauthenticity or expertise of the items. The buyer is responsible for checking the exhibitions prior to the sale.
